Terms of Service

These Terms of Service ("Terms") govern your access to and use of HEMA Competition Tools (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. About the Service
The Service provides tournament management tools, including participant registration, match generation, scoring, live display, judge interfaces, spectator views, and event organization features.
2. Eligibility and Accounts
- You must provide accurate and up-to-date account information.
- You are responsible for all activity under your account.
- You must keep your credentials secure.
- You must promptly notify us if you believe your account has been compromised.
3. Organizer Responsibilities
- Tournament organizers are solely responsible for the personal information they collect, enter, upload, or manage through the Service.
- You confirm that you have obtained all necessary authorizations, permissions, or consent from participants and any other individuals before submitting their information to the Service.
- You agree to comply with all applicable privacy, data protection, and other applicable laws when using the Service.
- The Service acts solely as a technical platform and does not verify the legality, accuracy, or origin of the data submitted by users.
4. Acceptable Use
- No unlawful, fraudulent, abusive, or misleading activity.
- You must not upload, submit, or share any content that is illegal, defamatory, injurious, abusive, harassing, threatening, hateful, obscene, or otherwise harmful to individuals or groups.
- You must not use the Service to store, publish, or distribute content related to criminal activity, exploitation, violence, or any other unlawful conduct.
- No attempt to disrupt, overload, probe, reverse engineer, or compromise the Service.
- No unauthorized access to accounts, systems, or data belonging to others.
- We reserve the right to review, remove, block, or restrict access to any content that we consider inappropriate, unlawful, or in violation of these Terms, at our sole discretion and without prior notice.
5. Content Reporting
If you believe that any content available through the Service is inappropriate, unlawful, or in violation of these Terms, you may report it by contacting us at contact@hema-tools.com.
We may review reported content and take action where appropriate, at our sole discretion.
6. User Content and Tournament Data
You retain responsibility for all data and content submitted through the Service, including participant information, match data, scores, media, and event details. We process this data only as needed to operate, secure, maintain, and improve the Service.
7. Public Display and Live Data
Certain tournament data, such as participant names, schedules, match results, rankings, and scores, may be publicly displayed through spectator views, public pages, or shared links. By using the Service, you acknowledge and accept this behavior.
8. Judge Access
Judges may access tournament interfaces through secure links, access codes, or QR codes. Organizers are responsible for managing and distributing such access securely.
9. Third-Party Services
The Service relies on third-party providers such as hosting, authentication, analytics, email services, and payment processing.
- Payment processing is handled by Stripe.

10. Payments and Donations
Payments and donations are processed entirely by Stripe, a third-party payment provider. We do not collect, process, or store any payment card information on our servers, and we do not have access to any payment details.
10A. YouTube Video Upload and Account Management
The YouTube feature is an optional technical tool that facilitates uploading a video to the channel selected by the user and referencing it in the corresponding match. HEMA Competition Tools does not own, operate, or manage any YouTube account or channel on the user's behalf.
- The account or channel owner remains solely responsible for its management, security, access, settings, and all activity performed through it.
- The user retains final control over the file, title, description, tags, playlist, privacy status, and initiation of each upload.
- YouTube authorization is temporary and specific to the user's browser session. We do not request or retain a refresh token; the short-lived access token is revoked when the user manually disconnects, and we attempt to revoke it when the user leaves or closes the page.
- The user warrants that they hold all necessary rights, authorizations, and consents for the videos and agrees to comply with image and publicity rights, copyright, applicable laws, the YouTube Community Guidelines, and the YouTube Terms of Service.
- The organizer certifies that every person who is recognizable or otherwise identifiable in a video has been informed of the recording, its intended publication on YouTube, and the processing of snapshots for moderation, and that the organizer has obtained their valid consent where required by law.
- The user authorizes the extraction of three snapshots at different points in the video and their transmission to OpenAI's moderation API. This automated analysis is intended to help identify potentially non-compliant content, but it does not guarantee detection of all prohibited content and does not replace the organizer's responsibility.
- If automated moderation fails or rejects the content, the YouTube link and match context may be submitted for manual review by an authorized administrator. Snapshots are not retained. Approval associates the link with the match; rejection leaves the video on the owner's YouTube account without displaying it publicly through the Service.
- We are not responsible for actions taken by YouTube, including rejection or interruption of an upload, removal or restriction of a video, demonetization, strikes, or account suspension or termination.
By using this feature, you also agree to the YouTube Terms of Service.
11. Intellectual Property
The Service, including its software, design, branding, text, and visual elements, is protected by applicable intellectual property laws. You may not copy, reproduce, redistribute, or reuse the Service or its content except as expressly permitted.
12. Availability
The Service is provided without any guarantee of uninterrupted availability, accuracy, or error-free operation. We may update, modify, suspend, or discontinue features at any time.
13. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, to the maximum extent permitted by law.
14. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising from the use of, or inability to use, the Service.
Our total liability for any claim relating to the Service is limited to the greater of CAD $100 or the amount paid by you to use the Service during the 12 months preceding the claim.
15. Suspension and Termination
We may suspend, restrict, or terminate access to the Service at any time, without prior notice, if we believe that a user has violated these Terms, created a security or legal risk, or engaged in inappropriate or unlawful behavior.
This includes the right to remove content, restrict access, disable accounts, or block access to the Service at our sole discretion.
16. Governing Law
These Terms are governed by the laws of Québec and the applicable laws of Canada.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the revised Terms.
